HOLLYWOOD, Calif. — Comedian Andy Dick will not be charged with sexual battery stemming from his arrest last month, prosecutors told The Associated Press on Monday.
The 42-year-old star still faces misdemeanor drug possession and battery charges and is scheduled to appear in court on Wednesday.
Riverside County District Attorney spokesman Ryan Hightower told AP that the former "NewsRadio" actor avoided the felony charge after prosecutors reviewed surveillance footage of the incident.
Dick was arrested on July 16 in a parking lot near the Buffalo Wild Wings Grill & Bar in Murrieta, Calif., shortly after a teenage girl accused him of pulling down her top at a restaurant.
Authorities later discovered one gram of marijuana and one Xanax anti-anxiety pill in the star's possession.
Dick was arrested and later released after posting a $5,000 bail.
Dick has had several run-ins with the law in the past. In 2004, he was arrested for indecent exposure at a McDonald's. He was also arrested in 1999 on marijuana and cocaine possession charges after he crashed his car into a telephone pole in Hollywood.
More recently, the South Carolina native was cited last August for urinating in public in Columbus, Ohio.
